Contract
Recently a relative of mine ran into a problem concerning her job. She was called up for an interview at a private school. When she got there she was given a contract that states that her job appointed to her was "school admin". The contract did not have the directors signature. But she went and signed the contract anyways and started work the following day. Bare in mind she was not given her copy of the contract.
When she reported for work, she was asked to go to the school library. There she met a young man who turned out to be a librarian. It was his last day on the job. Which means, that relative of mine was supposed to replace him. That got her thinking that this wasn't within her job scope.
The following day she did not turn up for work and called the school clerk. She told the clerk her concern that she applied for the post of school admin and not librarian. The clerk insisted that in the contract the job post indicated was "librarian". She then told the clerk that she will not be turning up for work. The clerk then said she needs to give atleast 2 weeks notice or she will need to pay a sum to compensate the school. In this case $500.
My relative then went to Ministry of Manpower. Unfortunately the ministry was unable to help without taking a look at the contract.
Her situation is still ongoing. What I would like to point out is the importance of reading EVERY SINGLE DETAIL of your contract before you commit your signature on it.
I too have gone through the same situation. Had an interview for a web designer job. When I was offered the position I didnt really notice how vague the details were. I just concentrated on landing my first job. Well things didnt really work out and in the end I lost about $700. So I hope this won't happen to anybody else.
Here's a list of things you should do when you are given a contract:
- Read every single detail
- Clear any doubts before you sign!
- If the contract does'nt really cover you or you feel uncomfortable about the agreement, make sure you tell the other party.
- Once both you and the other party has agreed upon the new details, get in on paper! Black and White. The different clauses in the contract will be the key in you winning the case if you decide to bring it to a judge. If it isnt included then well you're screwed!
- Lastly if after all the discussion and you still don't feel comfortable / bad gut feeling, trust your instincts and dont commit.
